我国亲属法目前主要表现为《婚姻法》和《收养法》。在制定中国民法典的过程中,必定要将其收回到民法典中,作为中国民法典的亲属法编或者婚姻家庭法编。因此,应当以完善亲属法的基本制度为基本目标。除了应明确亲属法改革的基本方向之外,还应着重完善我国亲属法的亲属制度、规定身份权、确立亲属法律行为、补充具体的亲属法律制度,以及建立与物权法相适应的亲属财产制度。

The present family law of China is represented by Marriage Law and Adoption Law,which have to be ab- sorbed into"Family Law"or"Marriage and Family law"part of Civil Code of China,during the process of the Chi- nese Civil Code legislation.Therefore,to improve the basic principles of Family Law should be set up as a primary goal.In addition to the efforts given to the establishment of general goals for the reformation of Family Law,special focus should also be given to the improvement of kindred system,provision of personality rights,establishment of le- gal act of Family Law,supplement of specification of legal system of family law,and formulation of family property system corresponding to the property right law.
