环境侵权救济机制是环境侵权救济的一系列方式、程序和规则的总称。我国当下没有专门的环境侵权救济机制,环境侵权救济是通过对传统民事侵权救济机制的拓展适用来实现的,其中诉讼机制是现行环境侵权救济机制的重要组成部分。从公民认知视角考察现行环境侵权救济诉讼机制的绩效,是机制有效运行的内在诉求。从实证角度分析,当公民自身环境权益遭受侵害时,普遍认为现行环境侵权救济诉讼机制在实体制度、程序制度以及责任制度上均存在不少法律难题,因而不会首选诉讼机制。这为更新环境侵权救济机制提出了迫切需求。

Environmental tort relief mechanism is the overall concept including a series of methods,proceedings and rules. At present,China has no special environmental tort relief mechanism. Environmental tort relief is realized by the expansion of traditional tort relief mechanism. And lawsuit mechanism is an important component of current environmental tort relief mechanism. Examining the performance of current environmental tort relief mechanism from the view of civil cognition is the internal appeal of effective operation. From the empirical point of view,when citizens was infringed of environmental rights,it is believed that current environmental tort relief mechanism has quite a few problems in physical system,proceeding system and responsibility system and so it is not first chosen. There is an urgent need to renew environmental tort relief mechanism.
